Washington, January 24 (UITV) – A US court has recently banned President Donald Trump’s order to end birthright citizenship, calling it unconstitutional. This order was given by Washington District Judge John Kaufner. Judge Kaufner called Trump’s executive order ‘clearly unconstitutional’ and issued a temporary restraining order to stop its implementation. He also said that at the time of signing this order, it was clearly visible that it could not be legally justified.
After this decision, Trump said that he would appeal against this decision. Trump told reporters in the Oval Office, “We will appeal against it.” Washington State Attorney General Nick Brown and other Democratic-led states had filed an emergency petition against this order, which was approved by the court. Through this petition, the court was requested to stop the order for 14 days before it comes into force.
Washington District Court Judge John Kaufner said that this order violates the 14th Amendment of the Constitution. This amendment of the US Constitution guarantees citizenship to all children born on American soil, regardless of the country of their citizenship. This means that children of immigrants born here also get American citizenship. This is why this order of Trump became a cause of legal challenge for Democratic-led states.
Judge Kaufner also said that he does not remember any case where an order is so clearly unconstitutional. He also raised the question that where were the lawyers when the decision to sign this order was taken. He said that this order was against the Constitution and it was not judicially appropriate to implement it. Along with this, he also expressed that a member of the bar is trying to prove it constitutional, it baffles him.
Under the US Citizenship Law, the concept of Birth Right Citizenship ensures that children who are born on US soil get American citizenship by birth. If Trump’s order is implemented, children born to immigrant parents will not get citizenship rights. Washington lawyer Len Polozola says that this order will have a negative impact on the rights of children across the country, because many problems will arise for those children who will not get citizenship rights.
Polozola says that this order will not only adversely affect the lives of those children, but it will also put a huge financial and logistical burden on the state governments, because without citizenship, these children will be deprived of many government benefits, which they receive as an American citizen. With such a change, state programs will face additional pressure and the availability of various services for these children may also be affected.
At the same time, Democratic leaders say that Trump’s order is against the basic principles of the Constitution and it violates laws that have been in force for many decades. They also say that implementing this order will create fear and instability among the immigrant community, which will make their life even more difficult.
This case can further intensify the debate on citizenship and immigration policy in America and more legal battles are likely to take place on this in the coming times. The Trump administration and its supporters can link it to the security and economic interests of America, while the opposition is challenging it as against human rights and the Constitution.
This case has become an important judicial test on the right to birth-based citizenship in America, which can have a profound impact on the American legal system and society in the coming times.
